COLUMBUS, OHIO β€” Two former FirstEnergy executives will face a second criminal trial in September following a deadlocked jury that resulted in a mistrial in the state’s largest corruption scandal, according to court records.

Summit County Common Pleas Judge Susan Baker Ross plans to begin the new trial on Sept. 28 for former FirstEnergy CEO Chuck Jones and ex-FirstEnergy Senior Vice President Michael Dowling. The executives face state criminal charges related to Ohio’s House Bill 6 utility corruption scandal.

Bribery Allegations Central to Case

The state’s criminal case centers on allegations that the former executives paid a $4.3 million bribe to a company owned by the late Sam Randazzo, weeks before he became Ohio’s top utility regulator. Additional charges include fraud, money laundering, records tampering, racketeering, and conspiracy.

FirstEnergy’s executives allegedly bribed officials to pass and protect HB 6, a 2019 law designed to bail out uncompetitive coal and nuclear plants while reducing the state’s clean energy standards. The legislation represents the largest corruption scandal in Ohio state history.

Ongoing Impact on Ohio Ratepayers

The effects of the scandal continue to impact Ohio residents today. Ohioans currently have less solar and wind power, pay higher energy bills, and experience more pollution as a direct result of HB 6, according to energy analysts.

The original trial marked a historic moment as the first criminal prosecution of utility executives in connection with the sweeping corruption scheme. The deadlocked jury and subsequent mistrial declaration came after weeks of testimony in Judge Ross’s Akron courtroom.

Federal Investigation Continues

The state criminal case represents one component of the broader investigation into the FirstEnergy corruption scandal. Federal authorities have also pursued related charges against other individuals connected to the scheme.

The retrial will provide prosecutors with another opportunity to present their case against Jones and Dowling, while defense attorneys will again argue for their clients’ innocence. The September trial date gives both sides additional time to prepare their strategies following the mistrial outcome.

House Bill 6’s passage in 2019 significantly altered Ohio’s energy policies by providing subsidies to aging power plants while rolling back renewable energy requirements that had been in place for years. The legislation’s defenders argued it would preserve jobs and maintain grid reliability, while critics contended it represented corporate welfare at ratepayers’ expense.
